These Terms of Service (“Terms”) govern your use of ForgeLingo (“Service”), operated by Light Tune Pty Ltd (ABN 20 684 152 618) (“we”, “us” or “our”).
By clicking “Accept” or otherwise expressly indicating your agreement, you agree to be bound by these Terms. If you do not agree, you must not use any part of the Service.
The Service is intended for users who are 18 years of age or older. By creating an account, you represent that you are at least 18 years old.
Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted or modified, including the consumer guarantees in sections 60 and 61 (services provided with due care and skill, and fitness for a disclosed purpose). See clause 10.
ForgeLingo is an AI-powered learning service that currently provides practice and feedback for language test preparation, focused on candidates preparing for the NAATI Credentialed Community Language (CCL) test. We may extend the Service to further practice or learning scenarios (for example, preparation for IELTS, TOEFL or any other examination) from time to time, and may add courses or other learning products — whether developed by us or provided with third parties — (clause 2.1). The same Terms apply across scenarios and features, and a new scenario or feature may be offered on a beta basis (clause 6.1) before becoming a paid plan. Its main learner-facing feature is:
| Capability | What it does | What it is |
|---|---|---|
| CCL Practice & Scoring | You listen to practice dialogues maintained by ForgeLingo, record and submit your interpretation in your language pair; the Service provides AI transcription, an indicative AI assessment of aspects such as fluency, accuracy and language quality, and AI-generated practice feedback | An indicative practice-feedback tool — not a NAATI assessment, test, certification or result |
All outputs are generated by artificial intelligence and are provided for reference only. You should exercise your own skill and care and independently verify all feedback before relying on it (see clauses 3–4 and 9).
We may offer courses, lessons or other learning content ("Courses"), developed by us or supplied by third-party providers or instructors. Where a Course is supplied by a third party:
Unless stated otherwise, your access to a Course is a personal, non-exclusive, non-transferable licence for your own learning. You must not record, download (except where a download is expressly offered), reproduce, redistribute, resell or share Course content, or share your account to give others access.
ForgeLingo provides self-directed practice in the scenarios we make available (including CCL test preparation), Courses (clause 2.1), and AI-generated transcriptions, scores and learning feedback. These outputs are intended to support your preparation and may contain errors.
The Service does not provide professional interpreting or translation advice, legal advice, migration advice or immigration assistance. It does not provide accreditation, certification, or an official assessment or interpretation of any NAATI test, standard or policy — or, in any other examination scenario the Service supports, of that examination body's test, standard or policy (see clauses 4.5 and 9).
AI-generated feedback is not a substitute for advice or assessment from an appropriately qualified professional where needed.
AI-generated transcriptions, scores, feedback and other outputs are provided for self-directed practice only. They may contain errors, omissions or inaccuracies, including where there is background noise, overlapping speech, accents or specialised vocabulary. You should use your own skill and care and independently verify outputs before relying on them.
Any score, percentage, pass indicator, readiness indicator or feedback produced by the Service is an internal practice output only. Even if it uses a 45- or 90-point scale or CCL-style criteria, it is not NAATI marking and must not be converted to, relied upon as or interpreted as a NAATI mark, band level, pass threshold, test result or likelihood of passing.
AI cannot assess all factors relevant to an actual NAATI CCL test, including test-day conditions and an examiner's judgement. It is not a human examiner, assessor or accredited practitioner.
If you make a decision about booking, postponing or taking an actual test in any examination the Service supports preparation for (including the CCL test), or about any matter that may rely on a test result — such as claiming migration points, applying for a visa, applying for admission or seeking professional registration — or another matter that may materially affect you, do not rely solely on the Service. You should:
ForgeLingo is not affiliated with, endorsed by, approved by, sponsored by or connected with NAATI (the National Accreditation Authority for Translators and Interpreters Ltd) in any way. "NAATI" and "CCL" are used only as factual references to the test that candidates may choose to prepare for.
ForgeLingo does not administer or issue an official CCL test, NAATI credential, migration decision, visa decision or invitation, or the official test, score, band, grade, result or credential of any other examination body (see clauses 4.5 and 9). We do not promise or guarantee that using the Service will produce:
Any score or feedback produced by the Service is indicative only and reflects AI-generated practice feedback, not an assessment of your actual or likely test performance. Only NAATI administers and assesses the CCL test, and only the Department of Home Affairs determines migration points. The Service plays no part in either process.
You are solely responsible for registering for, scheduling, paying for and attending any test directly with the examination body concerned (for the CCL test, this is NAATI), and for complying with that body's rules and requirements.
Practice dialogues and prompts made available through the Service are offered for CCL-style, self-directed practice only. We do not represent them as NAATI materials, actual, recalled, past or likely NAATI test content, or as a substitute for a NAATI test or assessment.
Where the Service refers to high-level CCL format information published by NAATI (for example, dialogue or segment structure or subject-matter categories), that reference only describes the practice format. It does not mean that a practice item is NAATI material, an official practice test, or NAATI-endorsed material.
You must not use the Service to seek, submit, store, request, obtain, reproduce, communicate or share actual or recalled NAATI test content, or other material that you are required to keep confidential. If you believe that material in the Service reproduces content in which you hold rights or should be treated as confidential test content, follow the notice process in clause 16.3.
This clause does not promise that every practice item is unique or incapable of resembling other content. Any assessment of a reported item will be handled under clause 16.3.
NAATI's own rules and candidate instructions provide, among other things, that all test materials are NAATI's property and are provided to a candidate solely for the purpose of taking the test, that candidates must not copy, reproduce or communicate test content to a third party, that candidates agree to maintain the confidentiality of test materials, and that a test may be invalidated or cancelled without refund — including a ban from future NAATI tests — where there is evidence of cheating or of prior knowledge of test materials. NAATI has also stated that it does not formally endorse any preparation course or organisation.
These rules are set by NAATI, may change, and are not controlled by us. You are responsible for reading and complying with the current NAATI rules applicable to you. In particular, you must not:
The Service is a language practice tool. Using it does not give you access to test content, and we do not encourage or accept any use that would breach NAATI's rules. We are not able to advise you whether a particular way of using this Service is consistent with NAATI's rules; for that, refer to NAATI directly.
If we extend the Service to practice scenarios for other examinations (for example, IELTS or TOEFL), this clause applies by analogy: that examination body's own confidentiality and conduct rules apply to you, and the prohibitions in clauses 4.4 and 7.2 apply equally to that body's test content and confidential materials.
To access certain features you must create an account. You agree to:
We may suspend or terminate your account if you materially breach these Terms (including the Acceptable Use rules in clause 7) and, where the breach is capable of remedy, you fail to remedy it within 14 days of notice, or where required by law, or where necessary to protect the Service, other users or third parties from harm. Where practicable, we will give you prior notice and the reason.
You may terminate your account at any time via your account settings or by contacting us (see clause 20).
Where we offer subscription plans or pay-per-use products, they are described on our pricing page. The Service is currently free: no purchase, top-up or subscription option is available at present (clause 6.6). All prices are in Australian dollars (AUD) and include GST where applicable. We use Stripe as our payment processor; your payment details are handled by Stripe under its own terms and privacy policy, and we do not store your full card number.
Beta features and paid plans may coexist. Parts of the Service (or new practice scenarios) may be offered on a beta basis — free of charge or at a discounted rate — while other parts are paid. Beta offerings may be less stable or complete, may change or be discontinued, and their availability is not guaranteed; we will identify what is in beta on the pricing page or in the relevant part of the Service. Where a scenario or feature is a paid plan, the consumer guarantees, cancellation and refund terms of this clause 6 apply in full. Nothing in this clause limits rights under the Australian Consumer Law that cannot be excluded (clause 1.2).
You may cancel a paid subscription at any time through your account settings or by contacting us (clause 20). Cancellation takes effect at the end of the current billing period, and you retain access until then. There are no cancellation fees.
Except as required by the Australian Consumer Law (including for major failures of our services, where you may be entitled to cancel and obtain a refund) or as otherwise agreed by us in writing, fees already paid are non-refundable for the remainder of a billing period. We do not provide refunds for change of mind. Pay-per-use products: if we fail to deliver the product, you will receive a full refund. Nothing in this clause limits any right you have under the Australian Consumer Law that cannot be excluded, restricted or modified.
We will give you at least 30 days' notice before any price increase applies to your subscription. If you do not accept the new price, you may cancel before the change takes effect and you will not be charged the new price.
(1) When you register an account, we give you a free allowance of 10 practice sessions. One session is deducted from your allowance when you start a practice session. If you do not complete the session, the deducted session is automatically returned to your allowance.
(2) If your free allowance is used up, you may email us at info@lighttune.com.au to request additional free sessions. Whether we approve a request — and how many sessions we grant — will be decided by us reasonably, based on your feedback and your usage of the Service. We will respond to each request within 5 business days.
(3) If we change the free allowance rules (including the number of sessions granted at registration), we will give you at least 30 days' notice before the change takes effect.
You may use the Service to practise and receive AI-generated feedback for your own preparation in any practice scenario we make available (including CCL test preparation), including recording your own voice and submitting the resulting recording for assessment. You may also access and use Courses (clause 2.1) and any other features we make available, for your own personal learning.
You agree not to:
You represent and warrant that any recording or other content you submit:
If content containing another person's personal information is submitted to us inadvertently, contact us at info@lighttune.com.au so we can delete it. We may delete content that appears to contain third-party personal information. We may also delete, and will not use for training or licence to anyone, content that appears to be NAATI test content (clause 4.5).
You retain ownership of content you submit, including your recordings and feedback you provide. You grant us a non-exclusive, royalty-free, worldwide, transferable and sub-licensable licence to host, use, process, store, reproduce, adapt, modify, create derivative works from, analyse, display, transfer copies of and distribute that content — to provide, maintain and secure the Service, and otherwise solely as described in clause 8.3 and our Privacy Policy (including sections 3 and 4).
Scores, transcriptions and other AI-generated outputs are for your information and personal use. You are free to use them for your own preparation. We do not claim copyright or other ownership in AI-generated outputs (content you submitted that is embedded in an output remains yours under clause 8.1).
We own all rights in the Service itself, and in derived data, aggregated data, statistics, derived features, embeddings, models and model improvements created or generated using the Service (as distinct from the outputs presented to you under this clause).
You must not present an output as a NAATI assessment, result, credential or the opinion of any accredited practitioner (clause 7.2).
Because outputs are generated by AI from your recordings and the Service's evaluation models, the same or similar outputs may be produced for other users with similar inputs.
We use your recordings, transcripts, scores and AI-generated outputs derived from them only to operate the Service for you — transcribing and assessing your recordings, returning your results and feedback, and maintaining your practice history. Our engineering personnel may access and export practice data only to the extent necessary to troubleshoot problems and keep the Service running (Privacy Policy, section 6). We do not include your content in any product-improvement dataset, use it to train or improve any model, or license or sell it to any third party. Nothing in this clause permits us to handle your personal information in breach of the Privacy Act 1988 (Cth). We do not sell or license your personal information to third parties. Third-party providers that process your recordings and transcripts on our behalf to deliver the Service (transcription and scoring, as described in our Privacy Policy, sections 3.1 and 4.1) are engaged under terms that limit their use of your data to providing those services to us.
If you send us feedback, suggestions or ideas about the Service, you grant us a perpetual, worldwide, royalty-free licence to use that feedback to improve and develop the Service. We are not obliged to pay you for it or to adopt it. This licence covers only the feedback you actually provide: it does not transfer ownership of any third-party content contained in your feedback, and it does not expand the purposes for which we may process your personal information beyond what these Terms and our Privacy Policy allow.
(1) Credits are an allowance of practice sessions used to access the practice features of the Service (see clause 6.6 for your free allowance). Credits have no cash value, are not transferable, and are not redeemable for money.
(2) We may issue credits from time to time, including as a sign-up allocation under clause 6.6 or through promotional activities. If any credits have an expiry date or other conditions, we will tell you at the time they are issued.
(3) If we make purchased credits available, pricing and terms for purchased credits will be published at the time of sale. The credits cost of each feature is the rate shown in the product at the time of each request. We may change rates prospectively with at least 30 days' notice, and a rate change does not reduce the value or number of credits you have already purchased.
The Service's scores and feedback are indicative practice feedback only:
To the maximum extent permitted by law, the Service is provided "as is" and "as available", and we do not warrant that it will be uninterrupted, error-free or secure, or that outputs will be accurate, complete or current. Availability of the Service is not guaranteed and may be affected by maintenance, third-party services and events beyond our reasonable control.
Our services come with consumer guarantees under the Australian Consumer Law that cannot be excluded. If a service supplied to a consumer does not comply with a guarantee, the consumer may require us to supply the services again or to pay the cost of having the services supplied again, and may otherwise be entitled to compensation for reasonably foreseeable loss or damage. Nothing in these Terms excludes, restricts or modifies those guarantees or our liability for failing to comply with them.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data, goodwill, test fees, preparation costs or opportunities (including CCL test fees, rescheduling costs or migration opportunities), arising out of or relating to the Service.
To the maximum extent permitted by law, and subject to clauses 10.2 and 10.5, our total aggregate liability for all claims arising out of or relating to the Service is limited to the greater of:
Where the services are supplied to you in trade or commerce and are not of a kind ordinarily acquired for personal, domestic or household use, and the Australian Consumer Law permits limitation under section 64A, our liability for a failure to comply with a consumer guarantee is limited (at our option) to supplying the services again, or paying the cost of having the services supplied again. This clause does not apply to liability that cannot be limited by law.
You agree to indemnify us, our officers, employees and agents against claims, losses, or costs (including reasonable legal fees) arising from your breach of these Terms, your unlawful use of the Service, or your infringement of third-party rights (including rights in content or recordings you submit). This clause does not require you to indemnify us for our own negligence or breach, and does not limit any right you have under the Australian Consumer Law.
The Service integrates with and relies on third-party services, including:
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
We may change AI providers, models, or service tiers from time to time. The notice we give depends on the materiality of the change:
Regardless of the provider or tier in use, you must not submit third-party personal information or sensitive information into recordings or AI features (clause 7).
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and disclose personal information (including your recordings and transcripts).
You may exercise your privacy rights — access, correction, deletion and export — at any time by contacting us at info@lighttune.com.au (Privacy Policy, section 8). We do not sell or license your personal information to third parties.
We may change the Service and will give notice of material changes before they take effect. For a material adverse change to a paid subscription, you may cancel as described in clause 6.3.
We may change these Terms and will give notice of material changes before they take effect. We give that notice by email to the email address registered to your account and by a notice in the Service. If a change introduces a new purpose or processing that requires consent, we will request that consent before using or disclosing information for that purpose; continued use alone will not replace an express choice where law requires one. If you do not agree to the revised Terms, you may cancel before they take effect.
If you have a complaint, contact us at info@lighttune.com.au. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.
Nothing in these Terms prevents you from exercising your rights under the Australian Consumer Law or any other law, or from contacting a regulator (including the Office of the Australian Information Commissioner for privacy complaints).
If you believe that any material in the Service reproduces content in which you hold rights, or that any material in the Service is, or appears to be, NAATI test content or content subject to exam confidentiality, send a notice to info@lighttune.com.au identifying the specific item, the basis of your claim, and your contact details. We will acknowledge a complete notice within 5 business days, review it, and where we consider it well-founded or reasonably substantiated disable or remove the item while the review is completed. We keep a dated record of each notice and of the action taken, and we notify affected users where removal changes content they were using. We do not adjudicate ownership of third-party content and we may refer disputes to the parties concerned.
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the jurisdiction of the courts of that state and the Federal Court of Australia.
